1. Acceptance of Terms

By accessing or using KnowYourNut ("the Service"), operated by Blue Collar Holdings LLC, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.

2. Description of Service

KnowYourNut provides financial calculators, a business plan generator, financial health scoring, and related tools designed for small business owners. Some features require a free account; others require a Pro subscription.

4. User Responsibilities

• Provide accurate information when using the Service.
• Do not use the Service for fraud, misrepresentation, or any unlawful purpose.
• You are responsible for the accuracy of all data you input.
• Maintain the confidentiality of your account credentials and notify us immediately of any unauthorized use.

5. Prohibited Conduct

You agree not to engage in any of the following activities:

• Scraping or copying: You may not scrape, crawl, copy, or extract the formulas, algorithms, or calculation logic used in any of our calculators or tools, whether by automated means or manual reproduction.
• Reverse engineering: You may not reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying algorithms, or proprietary methods of any AI features, calculators, or other components of the Service.
• Resale and redistribution: You may not resell, sublicense, redistribute, or make available any part of the Service, its output, or its underlying tools to third parties for commercial purposes without our prior written consent.
• Automated access: You may not use bots, scripts, or other automated tools to access the Service, submit bulk requests, or circumvent rate limits or access controls.
• Misrepresentation: You may not present AI-generated output from the Service as the work product of a licensed professional (CPA, attorney, financial advisor) when it is not.

Violation of these restrictions may result in immediate account termination and, where applicable, legal action.

6. AI-Generated Content and Data Processing

• Business plans and financial analysis are generated by third-party AI models, including Claude by Anthropic and OpenAI. When you use AI features, your relevant business and financial data is sent to these providers for processing.
• Before your data is sent to any AI provider, you will be asked to give your consent through an on-screen prompt. You may decline at any time.
• Our AI providers are contractually prohibited from using your data to train their models. Data sent to AI providers is used solely to generate your requested output and is not retained by them beyond what is necessary to complete the request.
• AI may produce inaccurate or incomplete statements, especially regarding local market conditions, regulations, or industry specifics.
• Financial projections are estimates based on your inputs. They are not predictions or guarantees of future performance.
• We strongly recommend professional review of all AI-generated content before relying on it.

7. Third-Party Integrations

• KnowYourNut allows you to connect third-party services, such as QuickBooks Online, to import your financial data into the platform.
• When you connect a third-party service, you authorize KnowYourNut to access your data from that service in read-only mode. We do not modify, delete, or write data back to any connected service.
• Your use of any connected third-party service remains subject to that service's own terms and privacy policy. KnowYourNut is not responsible for the availability, accuracy, or security of third-party services.
• You may disconnect any integration at any time from your KnowYourNut Settings. Disconnecting revokes our access and triggers deletion of imported data within 30 days.
• We do not sell, share, or distribute data imported from connected services to any third party, except as described in our Privacy Policy (for example, data may be sent to AI providers with your consent to power AI features).
• Financial data imported from connected services is provided as-is. We do not guarantee the accuracy or completeness of imported data. You are responsible for verifying that imported figures are correct.

8. Intellectual Property

• Your content: You own all business plans, calculator results, and other content you create using our tools.
• Our license: We retain a limited license to use anonymized and aggregated data to improve our services. We will never share your identifiable data for this purpose.
• Our property: All rights, title, and interest in and to the Service, including the KnowYourNut name, branding, design, source code, calculator formulas, algorithms, AI integrations, and all other underlying technology, are and shall remain the exclusive property of Blue Collar Holdings LLC. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.
• Trademarks: KnowYourNut and the KnowYourNut logo are trademarks of Blue Collar Holdings LLC. You may not use our trademarks without prior written permission.

9. Payment Terms (Pro Features)

• Pro subscriptions and lifetime purchases are processed by Lemon Squeezy.
• Refund policy: Contact us within 14 days of purchase for a full refund.
• We may change pricing with 30 days' notice to existing subscribers.
• Cancellation takes effect at the end of the current billing period.

10. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

• We are not liable for any decisions made based on AI-generated content, calculator results, financial projections, or any other output of the Service. You use all outputs at your own risk.
• Our maximum liability is limited to the total fees you have paid to us in the 12 months preceding the claim.
• We are not liable for loan denials, investment losses, business failures, tax penalties, regulatory actions, or any other financial outcomes that result from your use of the Service.
• We are not liable for errors, inaccuracies, or omissions in calculator outputs, AI-generated plans, or financial health scores. All outputs should be independently verified by a qualified professional before being used for business decisions, loan applications, investor presentations, or any other purpose.
• In no event shall Blue Collar Holdings LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, or lost business opportunities.
• You agree to indemnify and hold harmless Blue Collar Holdings LLC from any claims, damages, or expenses arising from your use of the Service or your reliance on its outputs.

11. Account Termination

• You can delete your account at any time through Settings. All your data will be permanently deleted within 30 days.
• We may suspend or terminate accounts that violate these Terms, engage in fraud, or misuse the Service, including any of the prohibited conduct described in Section 5.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Pennsylvania.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated terms on this page with a revised effective date. Your continued use of the Service after changes are posted constitutes acceptance of the new terms.
